Kuala Lumpur:Sessions Court A witness firmly denied altering the term 'advisory fee' to 'commission' in his statement to fit the case involving Sayed Amir Muzzakkir Al Sayed Mohamad under the Malaysian Anti-Corruption Commission (MACC) Act.
According to BERNAMA News Agency, Wan Azhar Mohamed Yusof, the managing director of Nexuscorpgroup Sdn Bhd, made this denial during a questioning session by lawyer Datuk Yaacob Md Sam, representing Sayed Amir Muzzakkir. Muzzakkir, a former political secretary, faces three corruption charges involving RM350,000.
Wan Azhar stated that the 'Project Advisory Agreement' was a five percent commission deal based on the project's value requested by Sayed Amir Muzzakkir and Datuk Seri Mohd Khairi Mat Jahya to help Nexuscorpgroup secure a tender for maintenance and supply services for the Royal Malaysia Police's RMPNet System.
During the session, Yaacob questioned Wan Azhar about the legality of changing terms in an agreement under the Evidence Act, to which Wan Azhar was uncertain. He also denied any intention to redefine 'advisory fee' as 'commission' to alter its character under the MACC Act.
The charges against Sayed Amir Muzzakkir, filed on May 23, 2024, accuse him of receiving and soliciting bribes as inducements to assist Nexuscorpgroup in securing the RMPNet tender, valued at over RM381.1 million. The alleged offenses occurred in December 2020 at different locations.
These charges fall under Section 16(a)(A) of the MACC Act 2009, which prescribes severe penalties, including a potential 20-year imprisonment and substantial fines upon conviction. The trial is scheduled to continue on October 7 before Judge Rosli Ahmad.
