Kuala lumpur: Prime Minister Datuk Seri Anwar Ibrahim and the Government of Malaysia have moved to dismiss a lawsuit initiated by five opposition Members of Parliament concerning the Malaysia-United States Agreement on Reciprocal Trade (ART).
According to BERNAMA News Agency, federal counsel Mohammad Sallehuddin Md Ali revealed the development during a case management session before Judge Datuk Azizan Md Arshad at the High Court. Meanwhile, P. Waythamoorty, representing the plaintiffs, informed the court that his clients are also seeking the Federal Court's opinion on constitutional questions related to the ART.
The court has scheduled October 8 to hear both the application to strike out the summons and the request for a constitutional reference. The legal action stems from the MPs' contention that the agreement, signed on October 26, 2025, was executed without requisite parliamentary consent.
This case follows a decision by the US Supreme Court on February 20, which deemed President Donald Trump's invocation of emergency powers for imposing reciprocal tariffs unconstitutional. The ruling upheld the lower court's findings that Trump exceeded his authority under the 1977 International Emergency Economic Powers Act.
The MPs involved in the lawsuit are Datuk Rosol Wahid (Hulu Terengganu), Fathul Huzir Ayob (Gerik), Datuk Awang Solahuddin Hashim (Pendang), Datuk Mas Ermieyati Samsudin (Masjid Tanah), and Datuk Abdul Khalid Abdullah (Rompin). They are challenging the agreement's legitimacy and seek a Federal Court decision on pertinent constitutional matters.
