Malaysia Strengthens Protections and Rewards for Cartel Whistleblowers

Kuala Lumpur:The Malaysia Competition Commission (MyCC) is set to enhance protections and provide rewards for whistleblowers who report cartel activities or bid-rigging, following amendments to the Competition Act 2010 (Act 712) and the Competition Commission Act 2010 (Act 713). According to BERNAMA News Agency, MyCC's chief executive officer, Datuk Iskandar Ismail, emphasized the importance of stronger protections due to the covert nature of cartel activities, which often occur behind the scenes. These protections are critical for whistleblowers who are connected with companies or consumers. Iskandar noted that while some protection previously existed, it was inadequate, leading to situations where complainants, having received no rewards, refrained from coming forward. He highlighted that potential job loss for whistleblowers who reveal confidential company information is a significant deterrent. With the amendments expected to be gazetted this year, MyCC aims to provide more comprehensive protection, ma king it easier for the public, particularly consumers, to report anti-competitive practices. The commission will also continue monthly advocacy programs for consumer awareness. MyCC is encouraging individuals or companies with information on cartels to report through various channels, including WhatsApp. The amendments will also expand MyCC's role in conducting impactful market studies, particularly in the digital economy and e-commerce sectors, as Section 11 of Act 712 empowers MyCC to conduct such studies. Cooperation with international competition agencies is also emphasized to prevent the domestic market from being affected by anti-competitive practices by global companies.
