Mantin: A lorry driver was fined RM30,000 after pleading guilty at the Sessions Court today to five charges of sending obscene messages via WhatsApp to his ex-wife's current husband in March 2023. Mohd Suhaimi Yusof, 50, entered the plea after the charges were read out before Judge Shahrul Rizal Majid, who also ordered a two-month jail term for each charge if he failed to settle the fine.
According to BERNAMA News Agency, the case details reveal that a man reported receiving several obscene pictures and videos via WhatsApp from Mohd Suhaimi, his wife's ex-husband. Mohd Suhaimi is accused of knowingly creating and transmitting the obscene pictures and videos with the intent to annoy the said man at Block Pulai Ria 13A, F103, Jalan UTL 9, Bandar Universiti Teknologi Lagenda, Mantin, between 7.22 pm and 9.59 pm on March 22, 2023.
He was charged under Section 233(1)(a) of the Communications and Multimedia Act 1998 (Act 588), which provides for a fine of up to RM50,000, a maximum jail term of one year, or both, upon conviction. Deputy public prosecutors Mohamad Farhan Kamarudin and Nadzirah Idris of the Malaysian Communications and Multimedia Commission (MCMC) appeared for the prosecution, while the accused was unrepresented.
Earlier, in mitigation before sentencing, Mohd Suhaimi left the matter to the court to determine the appropriate action against him, claiming his former wife had deceived him. He said he felt angry and at his wit's end, which led him to commit the act. He told the court that he was living in hardship, having slept in mosques and at rest and recreation areas. He added that he had four children, three of whom were still in school, and custody had been granted to his former wife.
Judge Shahrul Rizal then advised the accused to think carefully before taking any action. "Whatever you intend to do, think about the consequences. If you do something like this, you will have to bear the consequences. My advice going forward is that you must weigh the good and bad of every action you take," he said.
