Court Hears Details of Project Advisory Agreement in PDRM Tender Case

Kuala lumpur: The Sessions Court was told today that there was a Project Advisory Agreement between MKM Solutions Sdn Bhd and Nexuscorpgroup Sdn Bhd related to a maintenance services and spare parts supply project for the Royal Malaysia Police (PDRM). MKM Ticketing Travel and Tours Sdn Bhd director Nik Shazni Farhan Nik Mohammad Shah, 43, explained that the agreement involved assistance by MKM Solutions in preparing tender documents for the project.

According to BERNAMA News Agency, the agreement was valid for six months for the company to secure the tender. If unsuccessful, the agreement would be void. The agreement's value was set at five percent of the total contract, determined by Datuk Seri Khairi Mat Yahya, a director and shareholder of MKM Solutions. Payment related to this agreement was executed post-project commencement, amounting to approximately RM19 million from the RM381 million contract value.

Nik Shazni Farhan conveyed this information as the 10th prosecution witness during the trial of Sayed Amir Muzzakkir Al Sayed Mohamad, 43, a former political secretary to the ex-home minister Datuk Seri Hamzah Zainudin. Sayed Amir faces three corruption charges involving RM350,000. Nik Shazni Farhan stated he was unaware of Khairi's negotiations or dealings and only received instructions to review agreement documents.

The witness further clarified that the lawyer preparing the agreement liaised with him to set the terms, which he then communicated to Datuk Seri Khairi. The agreement was signed by Datuk Seri Khairi and Wan Azhar Mohamed Yusof, Nexuscorpgroup's managing director. However, he was not informed of the work executed by MKM Solutions for Nexuscorpgroup nor any commission involved.

Nik Shazni Farhan mentioned his acquaintance with Sayed Amir Muzzakkir since 2018, when he visited his former office in Bandar Seri Damansara. He was not well-acquainted with Sayed Amir as the latter's visits were primarily to meet Datuk Seri Khairi. It was not until 2020 that Nik Shazni learned of Sayed Amir's political role through the media.

During the trial, Nik Shazni agreed with defense lawyer Asmadi Hussin's suggestion that the business dealings between MKM Solutions and Nexuscorpgroup were genuine, noting the involvement of a lawyer in drafting the agreement. During re-examination, he expressed that the appointment of a lawyer for preparing the agreement signified a legitimate business practice, evidenced by the lawyer issuing an invoice for services rendered.

On May 23, 2024, Sayed Amir Muzzakkir was charged with two counts of receiving bribes totaling RM350,000 from Nexuscorpgroup's managing director, Wan Azhar Mohamed Yusof. The bribes were allegedly for aiding the company in securing a PDRM tender valued at RM381,112,042.44. The offences were purportedly committed in December 2020 at the Yayasan Tanah Aku office in Solaris Dutamas and the Nexuscorp Group office in Shah Alam.

The charges fall under Section 16 (a)(A) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, which carries a maximum jail term of 20 years and a fine of not less than five times the bribe value or RM10,000, whichever is higher, upon conviction. The trial, overseen by Judge Rosli Ahmad, will resume tomorrow.
