MOT Proposes Mandatory Compensation for DUI Offenders in Malaysia

Klang: The Ministry of Transport (MOT) is working on amendments to the Road Transport Act 1987 (Act 333) to mandate that individuals convicted of driving under the influence of alcohol or drugs provide compensation to the families of their victims. Transport Minister Anthony Loke announced that this compensation would be an addition to existing prison sentences under Act 333, reflecting the ministry's firm approach against drink-driving.

According to BERNAMA News Agency, amendments to Act 333 were enacted in the Dewan Rakyat and took effect in October 2020, introducing stricter penalties for offenders. Under Section 44 of the Act, individuals driving under the influence of alcohol or drugs who cause death may face imprisonment of 10 to 15 years and a fine between RM50,000 and RM100,000 upon conviction. Repeat offenders face harsher penalties, with imprisonment ranging from 15 to 20 years and fines between RM100,000 and RM150,000.

Minister Loke urged the Royal Malaysia Police to conduct a thorough investigation into a recent accident involving a motorcyclist in Klang. He emphasized the importance of referring the investigation paper to the Attorney General's Chambers for prosecution and expressed hope that the court will impose the maximum sentence if the offender is found guilty. The MOT extended condolences to the family of Amirul Hafiz Omar, involved in the incident, labeling it a tragic example of criminal negligence.

Klang Selatan district police chief ACP Lim Jit Huey reported that Amirul was killed after being struck by a car driven by an individual under the influence on Jalan Raya Barat in Klang. The accident, which occurred around 11.40 am, resulted in Amirul being thrown onto the roof of another car, leading to his death at the scene.
