High Court to Review Perikatan Nasional’s Challenge on Suspension Order

Kuala Lampur:The High Court has scheduled October 13 to hear Perikatan Nasional's (PN) application seeking permission to pursue a judicial review against the Registrar of Societies' (RoS) suspension order on the coalition's activities.

According to BERNAMA News Agency, the application will be reviewed by Judge Datuk Azizan Md Arshad at 9 am. PN and PAS secretary-general Datuk Seri Takiyuddin Hassan, along with secretaries-general Wong Chia Zhen of Parti Gerakan Rakyat Malaysia (Gerakan) and N. Sathes Kumar of the Malaysian Indian People's Party (MIPP), are the first to third applicants. The secretaries-general of Parti Wawasan Negara (Wawasan), Datuk Seri Saifuddin Abdullah, and Parti Pejuang Tanahair (Pejuang), Datuk Sazmi Miah, are the fourth and fifth applicants.

The respondents named in the case are RoS director-general Datuk Mohd Zulfikar Ahmad and Home Minister Datuk Seri Saifuddin Nasution Ismail. The applicants, through Messrs Siddiq Azani and Co, filed a certificate of urgency stating the suspension hinders their routine political activities, including using the coalition's name and symbol in the upcoming 16th Melaka State Election.

In a supporting affidavit, Takiyuddin stated that the suspension order issued on September 23 prevents PN from conducting political activities, convening meetings, or participating in the Melaka State Election. The order also restricts PN from issuing statements, holding public rallies, or campaigning, with the risk of prosecution for non-compliance.

PN is seeking an order of certiorari to annul the suspension order under subsection 13(2A) of the Societies Act 1966. This order halts all PN activities except for responding to a notice of intention to cancel registration. They are also contesting a notice dated September 22, 2026, under subsection 13(2) of the same Act, which suggests deregistering PN after 30 days.

The application claims the notice was based on PN's failure to invite Parti Pribumi Bersatu Malaysia (Bersatu) to a PN Supreme Council meeting on July 16, allegedly breaching Clause 7.1 of the PN Constitution. The applicants argue that the RoS lacks jurisdiction to determine Bersatu's membership status within PN, which should be governed by the PN Constitution. They also assert that the suspension was imposed without giving PN the opportunity to be heard and that they were not provided with Bersatu's complaint or supporting documents.
