Shah alam: The High Court has scheduled a hearing on November 27 for the government’s petition to wind up Bina Puri Sdn Bhd. This action is due to the company’s alleged non-payment of an outstanding income tax debt amounting to RM4.1 million for the Assessment Year 2016.
According to BERNAMA News Agency, revenue counsel Muhammad Syafiq Muhamad Sharif, representing the Malaysian government, announced that Shah Alam High Court judicial commissioner Datuk Raja Rozela Raja Toran fixed the date during a case management session conducted via video conference. The hearing will address whether Bina Puri will be wound up or if a settlement will be reached between the parties involved.
The government filed the petition on June 23, claiming that Bina Puri has an outstanding tax debt of RM4,199,439.96 for the Assessment Year 2016, including tax increases. This arrears amount is based on the Income Tax Return Form (Borang e-C) that Bina Puri self-reported on August 30, 2017.
The petitioner stated that a Payment Demand Notice was served to Bina Puri on January 20, 2025. However, the company failed to comply with the notice within 21 days of its delivery. This non-compliance classifies the respondent as unable to pay its debt under subsection 466(1)(a) of the Companies Act 2016.
Consequently, the petitioner seeks to wind up Bina Puri under subsection 465(1)(a) of the Companies Act 2016 due to the company’s failure to settle its debt. Additionally, the petitioner has requested the appointment of an official receiver as a liquidator.
