Gombak Setia Rep Hilman Idham Acquitted Of TikTok Public Alarm Charge

Gombak: Gombak Setia assemblyman Muhammad Hilman Idham was acquitted and discharged by the Magistrate's Court here today of a charge of making a statement on TikTok that allegedly could cause public alarm. Magistrate Nurul Izzah Hasan Basri found that the prosecution had failed to establish the essential elements of the charge under Section 505(b) of the Penal Code.

According to BERNAMA News Agency, the court concluded that the prosecution had not established a prima facie case against the accused by the close of their argument. Consequently, the court decided to acquit and discharge Muhammad Hilman without requiring him to enter his defence. The court also ordered the return of the RM4,000 bail.

The charge against Muhammad Hilman alleged that he made a statement on TikTok at 2.09 pm on July 30, 2025, which could cause public alarm and potentially induce someone to commit an offence against public order. The video was reportedly viewed by a police officer from the Commercial Crime Investigation Department at Menara KPJ.

The charge was brought under Section 505(b) of the Penal Code, which stipulates a maximum penalty of two years imprisonment, a fine, or both for those found guilty. In the proceedings, Muhammad Hilman was represented by lawyers Muhammad Rafique Rashid Ali and Nur Mustanir Md Nor, while Deputy Public Prosecutor Nurul Farhanah Arul Hisham led the prosecution.
