Food Vendor’s Family May Sue If Dissatisfied With Insurance Compensation – MBDK

Kuala Lumpur: The family of a food vendor who died after being struck by a fallen tree on Monday may take legal action if they are dissatisfied with the compensation offered by the insurer.

According to BERNAMA News Agency, Royal Klang City Council (MBDK) Mayor Datuk Abd Hamid Hussain stated that the local authority’s insurance policy does not specify a fixed compensation amount, but the council remains open to discussions with the insurer.

Mayor Abd Hamid mentioned that, should the compensation offered prove unacceptable to the family, they have the option to file a claim in court, which would then determine the compensation amount. This was conveyed at a press conference following the launch of the Klang Sustainable Stormwater Plan 2025-2030.

The media had reported that MBDK is currently in discussions with the insurer regarding compensation for 46-year-old Aszehari Ansar’s next of kin under the council’s public liability insurance. His widow, Siti Norwani Mohamed, 41, has yet to decide on taking legal action against those responsible for the tree’s collapse, which occurred on Jalan Batu 3, Kampung Bukit Kuda.

Mayor Abd Hamid emphasized the council’s commitment to expediting the resolution process to assist the family, acknowledging that insurance claims typically take three to six months. However, he noted that if the case proceeds to court due to a dispute over the compensation amount, the timeline will depend on the legal proceedings.
