Kuala Lumpur:The driver of a BYD car involved in a fatal accident on Jalan Kuching, which resulted in the death of a five-year-old girl, faced charges today. Bank officer Raeven Goh Wey Haur, aged 24, pleaded not guilty to three offences, including dangerous driving causing the child's death.
According to BERNAMA News Agency, the first charge accuses Goh of driving a BYD Seal dangerously, leading to the death of Asiah Ahmad Syahir. This charge falls under Section 41(1) of the Road Transport Act 1987, carrying penalties of five to ten years imprisonment and a fine ranging from RM20,000 to RM50,000 upon conviction. Additionally, disqualification from holding or obtaining a driving licence for at least ten years from the conviction date is possible.
The second charge alleges Goh drove dangerously considering the traffic conditions, under Section 42(1) of the same Act. This could lead to a maximum five-year jail term, a minimum RM15,000 fine, and a driving licence disqualification for at least five years if convicted. The third charge is for failing to stop after the accident, under Section 52(1), which carries a maximum fine of RM2,000 or up to six months imprisonment upon conviction.
All offences occurred along Jalan Kuching while heading towards Jalan Segambut at 3.44 pm on October 10. The prosecution, led by deputy public prosecutor Mohamad Fadhly Mohd Zamry, recommended a RM50,000 bail with one surety due to the seriousness of the charges. Additional conditions included surrendering the accused's passport and suspending his driving licence until the case concludes.
Defense lawyer Khailash Sharma requested lower bail, emphasizing the family's cooperation with the police. The accused’s father, a businessman, was proposed as the surety. Consequently, the court set bail at RM36,000 with one surety, adhering to the prosecution's additional conditions. The case will be mentioned again on November 19.
The victim's family attended the court proceedings, accompanied by their lawyer, Nur A'minahtul Mardiah Md Nor. Earlier reports indicated that the young girl, traveling in a Perodua Bezza, suffered severe head injuries in a six-vehicle collision and was pronounced dead at Kuala Lumpur Hospital.
Police investigations suggest the crash occurred when the BYD Seal, allegedly driven by the accused, rear-ended the Bezza, causing it to collide with other vehicles. The Bezza driver, the victim's father, and a motorcyclist were also injured.
