Jakarta:A businessman has pleaded not guilty in the Sessions Court to a charge of criminal breach of trust involving RM101,679.98 belonging to a property development company.
According to BERNAMA News Agency, Lee Lun Teong, aged 44, formerly a director at Menarez Development Sdn Bhd, is accused of transferring the said amount from the company's account to his personal bank account as a 'Director's Fee', although he was not entitled to receive such a payment.
The alleged offence took place at the company's premises on Jalan Residen 3, Desa Parkcity, between November 1 and December 7, 2024. The charge falls under Section 409 of the Penal Code, which stipulates a penalty of imprisonment ranging from two to 20 years, whipping, and a possible fine upon conviction.
Deputy Public Prosecutor Muhammad Zul Hilmi Latiff did not propose bail, citing the non-bailable nature of the offence. However, he suggested that if the court were to consider bail, it should be set at RM30,000 with one surety, and that Lee should surrender his passport until the conclusion of the case.
Lee's defence counsel, Wan Shahrizal Wan Ladin, argued for a bail amount of RM20,000 without the passport surrender condition, stating that Lee was not a flight risk and required his passport for business travel. He proposed that reporting to a police station would suffice as a condition for bail.
Judge Azrul Darus granted bail to Lee at RM20,000 with one surety and mandated that he report to the nearest police station once a month. The court scheduled the next mention and document submission for December 9.
